Multitude of Possible Legal Problems

Brokers must work through a multitude of legal issues, even beyond the typical issues of preparing property titles, inspections, contracts, etc. For instance, they must know whether or not they are entitled to a commission in unusual cases. They must know how to comply with real estate law when a buyer or seller breaks a purchase agreement, listing agreement, or other real estate contract.

Standards of Care

It can also be extremely difficult to know who to represent in a sale and how to enforce your rights. Real estate law now allows brokers to represent buyers, sellers, both, or none, but they must now the different standards and obligations they owe depending on who they represent.

Too many brokers get caught in traps where they should represent themselves, but still have to put buyers' and sellers' interests first. You many have a fiduciary duty to one party, while the other is only a customer. I can help brokers get through these difficult situations.

Disputes

One of the most important duties in my real estate law practice is to keep brokers out of court. I help brokers stay out of trouble by guiding them through legal minefields. When disputes arise, I can resolve them without the expense and uncertainty of going to court. I can also represent brokers before the Pennsylvania Real Estate Commission.
